Definitions

a)     “QAC” has the meaning Queen Angel Creations.

b)     Product’ means each good or service that is advertised on the Site.

c)     “RAN” Return Action  Notice  (Number)

d)     This website at www.queenangelcreations.com (the “Site”) is a shopping website where you can browse, select and order products advertised on the Site

 1. General 

a)     Please read these terms and conditions before accessing or using the Site. Anyone  under 18 years of age, cannot place an order under their name, they must obtain  parental or guardian’s consent before accessing and using the Site.

b)     Use of site Queen Angel Creations (QAC) controls this website this website is based in London, England. Persons who access this site from outside England are solely and individually responsible for compliance with all their local laws which may be applicable

c)     Your access to and use of the Site, including your order of Products through the Site, is subject to these terms and conditions.

d)     You agree to be bound by and comply with these terms by using the Site, completing the registration through the site and or obtaining products from us using the Site

e)     No agreement will be established  until  QAC has received cleared funds

 2. Our rights

a)     As most of our products are lovingly hand finished there may be slight variations between designs.

b)     The information contained in this Site is provided in good faith on an “as is” basis. QAC does not represent or warrant to the reliability, accuracy or completeness of the information contained on this Site. QAC has made reasonable efforts to provide information as accurate at the time and date of publication

c)     The prices, descriptions and materials used for the finished product can be changed at  short notice or withdrawn due to  supply, demand or internal processes and procedures

d)     You agree that QAC  and its directors, employees and other representatives shall not be responsible nor liable for any claims (direct, indirect or consequential losses and damages) arising in any way (including without limitation negligence) for errors in, or omissions from, the information in this Site.

e)     QAC reserve the right to supplement and amend  Terms and conditions on which at any time, and such modifications will be effective as soon as they are posted. It is your responsibility  to review the Terms and Conditions on each occasion you access the Site. By continuing to use the Site after these terms and conditions have been modified, you agree to be bound by the changes to these  new terms and conditions. If you have an order that has been accepted by us, the terms and conditions that will apply to the order, are the terms and conditions that applied at the time you placed your order.

 3. Prices

a)     The prices of Products and delivery and other charges displayed on this Site are current at the time of issue, however, QAC reserves the right to change prices at any time.

b)     All prices shown on this Site are in Pounds Sterling (GBP).

c)     The purchase price of each Product is shown on the product list on the Site at the time you place your order. The purchase price of a Product on the Site may not be the same or correspond to the prices in any of our  offline promotions.

d)     You acknowledge that QAC are not required or obliged to match any prices for any Products, including matching any prices for a Product that is available through the Site at our offline promotions or vice versa.

 4. Links

a)     The Site may contain links to external websites that are not operated by us. QAC does not make any endorsements, or representation as to the accuracy of information contained within those websites. These links are provided for your convenience only and you agree that:

b)      make no representations or warranties, or have any responsibility or liability for those websites;

c)     these links do not indicate, expressly or impliedly, that QACendorse the site or the products or services that are provided at those sites; and

d)     you access and use the products and services made available at those sites solely at your own risk.

 5. Intellectual Property

And you:

a)     acknowledge that the copyright in the Site, the software, design, text and graphics comprised in the Site, the selection and layout of the Site and the content and materials on the Site (together, the “Materials”) are owned by or licensed to us;

b)     must not modify, copy, adapt, store in a retrieval system, reproduce, upload, post, transmit, sell, distribute in any way or communicate to the public a Material without our prior written consent; and

c)     must not frame or embed in another website any of the material appearing on this Site  as this is prohibited without our prior written consent.

You can:

a)     store a reproduction of the content on this Site on your local computer for the sole purpose of viewing the content and Materials; and

b)     print hard copies of the content and Materials for the sole purpose of viewing and purchasing Products but not for any other use, including commercial use.

c)     QAC is the Trademark  of Queen Angel Creations,  this Site contains registered trade marks and other trade marks  product names and company names and logs are the property of their respective owners and of  which  they are protected by law.

You must:

a)     not use any of the marks or trade marks appearing on the Site or our name or the names of our related bodies corporate without our prior written consent.

b)     not use any of the other company, product and services marks on the Site that are owned by other third parties (including our suppliers) without obtaining the relevant third party owner’s consent.

6. Placing an Order for Products

a)     You may order Products by selecting and submitting your order through the Site in accordance with these terms and conditions.

b)     Any order placed through this Site for a Product is an offer by you to purchase the particular Product for the price notified (including the delivery and other charges) at the time you place the order.

c)     QAC may ask you to provide additional details or require you to confirm your details to enable us to process any orders placed through the Site.

d)     you agree to provide us with current, complete and accurate details when asked to do so by the Site.

7. Acceptance or Rejection of an Order

a)     reserve the right to accept or reject your order for any reason, including (without limitation) if the requested Product is not available, if there is an error in the price or the product description posted on the Site or in your order.

b)     Each order placed for Products through the Site that QAC accept results in a separate binding agreement between you and us for the supply of those Products. For each order accepted by us, will supply the Products in that order to you in accordance with these terms and conditions.

c)     If QAC reject an order placed through the Site, then QAC will endeavour to notify you of that rejection at the time you place the order or within a reasonable time after you submit your order.

8. Cancelling an Order

a)     QAC may cancel any part of an order (including any orders that QAC have accepted) without any liability to you for that cancellation at any time if:

I.        the requested Products in that order are not available; or

II.        there is an error in the price or the product description posted on the Site in relation to the relevant Product in that order; or

b)     If we do so, then QAC will endeavour to provide you with reasonable notice of that cancellation, and will not charge you for the cancelled order if QAC cancel it before the delivery date or if you are not at fault or in breach of these terms and conditions.

9  Delivery and packaging of Products and Charges

a)     Please allow at least Fourteen  (14) working days for delivery from the receipt of your order and payment for your order,  Delivery time is subject to stock availability, this period may be extended by up to 30 days .

b)     Delivery and  package fees are payable in addition to the purchase price of each Product. A number of different packages and  delivery methods may be used depending on the type of order.

c)      You are  responsible for collecting the parcel /package if you are unavailable at the time   the gift was delivered and it has to be sent to collect from a depot  then you  will have to pay additional charge for re-delivery.

d)     QAC currently delivers  orders to UK only.

e)     You acknowledge and agree that you may incur additional delivery fees/ other (in addition to the fees and charges specified above) for:

I.        Special, non-stock and/or bespoke items;

II.        heavy, bulky and/or awkward items;

III.        express or urgent deliveries; or

IV.        bulk or large quantity orders.

10.   Returns

a)     You need to notify QAC by writing/ email  within Seven (7) days of delivery of any Products, else,  the Products shall be deemed to have been accepted by you.

b)     QAC will accept product returns and provide you with (at QAC discretion) a replacement for the Product (subject to availability) an exchange, a credit note or  refund  where you provide:

i.        the Order number, invoice number or receipt number;

ii.        a detailed description of the problem or the reason for your request to the return the Product;

iii.        photograph(s) of product that is damaged during transportation (if it’s required  QAC will advise you which email address to send it to);

iv.        your name and contact details.

v.        QAC will evaluate your return request and issue you with a Returns Action  Notice once QAC have received details of your return request.   QAC will send you a RAN  number and outcomes with  return address. If QAC feels the problem described requires clarification QAC may contact you to clarify in order to provide more efficient service.

c)     Where the Product is covered by a warranty from the manufacturer of the Product,  QAC recommend you first contact the relevant manufacturer if you experience any difficulties or have any concern regarding the relevant Product.

11.  Force Majeure
QAC reserves the right to defer the date of delivery or to cancel the Contract or reduce the volume of the Goods ordered by the Your (without liability to  You) if it is prevented from or delayed in the carrying on of its business due to circumstances beyond the reasonable control of QAC including, without limitation, acts of God, governmental actions, war or national emergency, acts of terrorism, protests, riot, civil commotion, fire, explosion, flood, epidemic lock-outs, strikes or other labour disputes (whether or not relating to either party’s workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials; Provided that, if the event in question continues for a continuous period in excess of ninety days, the Customer shall be entitled to give notice in writing  QAC to terminate the Contract.

12. Your Obligations

You agree that:

a)     All information and data provided by you to us through the Site (including as part of the customer registration process) or otherwise is true, accurate, complete and up to date;

b)     the person receiving the Products at the Delivery Address is authorised by you to do so;

c)     you have and will comply with all relevant laws relating to your use of the Site and your placement of any order to us;

d)     you will promptly advise us of any changes to your information provided to us as part of the customer registration process;

e)     you are responsible for any costs associated with your access to or use of the Site, including Internet access fees;

f)      you will check the labels on the Products before opening

You will not:

a)     use the Site for any activities that breach any laws, infringe a third party’s rights or are contrary to any relevant standards or codes;

b)     use the Site in a manner or way, or post to or transmit to or via the Site any material, which interferes with other users or our other customers or defames, harasses, threatens, menaces or offends any person or which prevents any other person from using or enjoying the Site;

i.        make fraudulent or speculative enquiries, purchases or requests through the Site;

ii.        use another person’s details without their permission or impersonate another person when using the Site;

iii.        post or transmit any obscene, indecent, inflammatory or pornographic material or any other material that

iv.        may give rise to civil or criminal proceedings;

v.        tamper with or hinder the operation of the Site;

 13. Viruses and Malicious codes

a)     QAC does not claim that any information (including any files) obtained from or through this Site is free from viruses or other faults or defects or malicious codes.

b)     You are responsible for your own firewalls, IT security management, scanning any information for viruses, Trojan horses and other malicious codes.

c)     You agree that QAC has no responsibility or liability to you or any other person for any loss or damage (whether direct, indirect, consequential or economic), regardless of cause, negligence or otherwise, which may be the direct or indirect result of any such information.

You will not:

a)     knowingly transmit any viruses, worms, defects, trojan horses or similar disabling or malicious code to the Site;

b)     use any robot, spider, site search and retrieval application or other mechanism to retrieve or index any portion of the Site;

c)     modify, adapt, translate or reverse engineer any portion of the Site;

d)     remove any copyright, trade mark or other proprietary rights notices contained in or on the Site;

e)     reformat or frame any portion of the web pages that are part of the Site;

f)      create accounts by automated means or under false or fraudulent pretences;

g)     use the Site to violate the security of any computer or other network or engage in illegal conduct;

h)     take any action that imposes or that would, in our reasonable opinion, result in an unreasonable or disproportionately large load on our infrastructure;

i)      use the Site other than in accordance with these terms and conditions; or

j)      attempt any of the above acts or engage or permit another person to do any of the above acts.

14. Warranty and Liability

a)     QAC exclude all implied terms and warranties whether statutory or otherwise, relating to the Site or the subject matter of this agreement. You acknowledge that the Site is provided “as is” and that  QAC do not make any warranty or representation as to the suitability of the Site or a Product for any purpose.

b)     QAC will not be liable to you for indirect and consequential loss (including without limitation for loss of revenue, loss of profits, failure to realise expected profits or savings and any other commercial or economic loss of any kind) or loss or corruption of data, in contract, tort, under any statute or otherwise (including negligence) arising from or connected to this agreement.

c)     Our liability to you for loss or damage of any kind arising out of this agreement or in connection with the relationship established by it is reduced to the extent (if any) that you cause or contribute to the loss or damage. This reduction applies whether our liability is in contract, tort (including negligence), under any statute or otherwise.

d)     Nothing in these terms and conditions is intended to limit or exclude any liability that cannot be excluded by law.

 15. Do-It-Yourself Content

You acknowledge that the video clips and photographs contained in this Site may depict activities undertaken by qualified and highly trained professionals and/or experts.

a)     You agree not to attempt to replicate any activities shown on this Site unless you have:

b)     checked the service information and specification for the specific Product, that you are using or working on as the correct method may be different to any generic example shown in this Site;

c)     obtained advice from the relevant qualified experts, trades people and/or professionals;

d)     complied with all applicable laws, regulations and by-laws; and

e)     employed safe practices for carrying out the activities.

f)      You release QAC  its directors and employees from all Liabilities that is or may be incurred or suffered by you as a result of you carrying out the activities shown in this Site.

16. Jurisdiction

This agreement, formation,  performance, validity is governed by  English Law and the parties submits to the exclusive jurisdiction of English Courts.
